Welcome to Freetivity ("Freetivity," "we," "our," or "us"). We’ve always tried to provide a clear human-readable Privacy Policy. We are committed to protecting your personal information and your right to privacy. The spirit of this policy remains the same: we aren’t here to exploit you or your info. We just want to bring you great new videos (including gacha content) and creators to enjoy on a site that prioritizes creative freedom and content protection, and the systems we build to do that will sometimes require stuff like cookies. We love you and we respect your privacy.

This Privacy Policy describes how Freetivity may collect, use, and share your personal information in connection with our online streaming platform located at https://www.freetivity.net/ (the "Website"), our mobile applications (the "Mobile Application"), and any other websites and platforms we own and operate that link to this Privacy Policy (collectively, and together with the Website and Mobile Application, the "Platform"), and our related services, events, social media pages, and email and other electronic communications (collectively, and together with the Platform, the "Services").

Freetivity reserves the right, at any time, to modify this Privacy Policy. While we may endeavor to notify you of significant changes (for example, by email or a notice on our Services), we are under no obligation to do so unless required by applicable law. We encourage you to review this Privacy Policy periodically to stay informed about our most current policies and practices. The "Last Updated" date at the top of this page indicates when this PrivacyPolicy was last revised. Your continued use of the Services following the posting or other notification of changes constitutes your acknowledgement and acceptance of such changes, where permitted by law.

1. Information We Collect

We strive to collect only the personal information that we need. What we collect and how we use it depends on how you engage with our Services. We collect information you provide to us, such as your name, email address, address, postal code, payment method (if applicable), and telephone number. Other information is collected when you choose to provide reviews, ratings, membership preferences, or otherwise provide information to us through our service or elsewhere. If you log in using third-party accounts (e.g., Google, Discord, Facebook), we may access basic information from those accounts as permitted by you and the respective platforms.

  • Contact details: such as your first and last name, email and mailing addresses, and phone number.
  • Account information: such as your username (email address) and password that you set to establish an online account with us, your watch history (e.g. for videos, gacha content), preferences, and other details about your use of the Services.
  • Payment and transactional data: such as the information needed to complete your subscriptions or other purchases on or through our Platform (all payment processing services connected with your use of the Platform are provided to you by our third-party payment processor), and records of subscriptions or items you have purchased from us.
  • Marketing preferences: such as your preferences for receiving communications about Freetivity content (including new video or gacha releases), activities, events, publications, and related services, and details about how you engage with our communications.
  • Survey responses: such as the information you provide in response to our surveys, questionnaires, or contests.
  • Communications: such as the information associated with your requests or inquiries, including for support, assistance, or order information, and any feedback you provide when you communicate with us, or otherwise.

Unless we specifically request it, we ask that you not provide us with any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Services, or otherwise to us.

We collect information regarding you and your interactions with us from using our service and website including, but not limited to, your IP address, your visits to the website, traffic data, location data, ad data, weblogs and other communication data, connection information, and the information regarding your computer or other device used to access our service. This information may include content title selections (e.g., videos, gacha series), search and watch history, and your interactions with customer service (such as the date, time and reason for contacting us, transcripts of any chat conversations, and if you call us, your phone number).

This automatically collected information may include:

  • Device information: such as your computer or mobile device operating system type and version number, wireless carrier, manufacturer and model, device identifier (such as the Google Advertising ID or Apple ID for Advertising), browser type, screen resolution, IP address, general location information such as city, state or geographic area.
  • Online activity information: such as information about your use of and actions on the Services, such as the website you visited before browsing to our Services, pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access.

Freetivity may receive personal information about you from other third-party sources, including from our service providers, data analytics partners, social media platforms (if you interact with us through them), advertising partners, business partners, data providers, publicly available sources, and third party APIs. We may merge or combine such personal information with the personal information we collect from you directly or automatically.

Referrals:

Users of the Services may have the opportunity to refer contacts to us and share their contact information. Please do not provide us with someone's contact information unless you have their permission to do so.

2. How We Use Your Information

We use the personal information we collect to provide, analyze, administer, enhance and personalize the service and marketing efforts for you and others. This includes processing your registration, orders and payments, and to communicate with you on these and other topics. From time to time, we may partner with companies whose products we believe will interest our members. In conjunction with these partners, we may send promotional announcements and/or serve web-based advertisements on their behalf, as permitted by law.

  • To Provide the Services: Fulfill your requests for content (like videos or gacha series), subscriptions, or other services; establish, manage, monitor, and maintain your account; improve and personalize your experience on our video site; verify your identity; communicate with you; provide maintenance and support; and fulfill any other purpose for which you provide personal information.
  • Research and Development: To study and improve the Services and our business, understand and analyze usage trends and preferences, and develop new features and services for Freetivity. We may create aggregated or de-identified data for these purposes.

  • Creators: We may share certain information with Creators you support or interact with (e.g., for video or gacha content), such as your username or level of support, to enable them to understand their audience and fulfill any rewards or perks. If a Creator leaves the platform, they may be provided with contact information of their supporters if you have consented.
  • Advertising Partners: We may share information with third parties for advertising campaigns as described in "Interest-Based Advertising."
  • Professional Advisors: With persons, companies, or professional firms providing Freetivity with advice and consulting in accounting, administrative, legal, tax, financial, and other matters.
  • Legal Requirements: To meet legal, regulatory, audit, security and financial requirements under applicable laws.
  • Compliance, Fraud Prevention, and Safety: To prevent, detect and investigate potentially prohibited or illegal activities, including fraud, and enforcing our terms of use (relevant to content protection and our stance against unfair takedowns); and to protect the rights, privacy, safety or property of Freetivity, you, or others.
  • Aggregated/Anonymous Data: On an aggregated or anonymous basis, to disclose content ratings, consumption behavior (e.g., video, gacha series views), commentary and reviews, or for other purposes not explicitly set forth in this policy.
  • Promotions: If you enter a contest or other promotion offered by Freetivity, to use your name and certain other information to administer the promotion.
  • Business Transfers: If we are involved in the sale or transfer of some or all of our businesses, to disclose your personal information to the acquiring organization, but will require the acquiring organization to agree to protect the privacy of your personal information in a manner that is consistent with this privacy policy.
  • Social Networking: If the service connects you to use social networking features or have social networking plugins available, your personal information may be collected, used or disclosed by other users of the website without restriction, according to your settings on those services.
  • Public Postings: If you cause any information to be disclosed in online postings, such as reviews or comments on the platform, it is made public and we are not responsible for any third-party's use of information you publicly disclose through our service.

When you view the website, we collect and store some information on your computer. This information will be stored in a 'Cookie,' which is a file created on your computer’s hard drive, and will help us in many ways.   • Session-Replay Technologies: Third-party software used to record a video replay of users' interactions with the Services to help us troubleshoot problems, understand user interaction, and identify areas for improvement.
  • Software Development Kits (SDKs): Third-party computer codes used in connection with our Mobile Application for analytics, features, or functionality, which may enable third parties to collect information directly via our Mobile Application.
5. Your Choices and Rights

You have certain choices regarding your personal information:

  • Access and Update Your Information: You can access and update certain personal information through your Freetivity account settings. For other modifications, please contact us.
  • Delete Your Account: If you wish to delete your account with us, you may do so by logging into your account and selecting "Delete account" (or by contacting us). Note that we may keep historical information in our backup files as permitted or required by law.
  • Marketing Communications: You may opt out of receiving marketing e-mail communications by clicking the "Unsubscribe" link at the bottom of the e-mail received or by adjusting your preferences in your account settings. It may take us up to 10 business days to process your request. Note that you may still receive service-related communications.
  • Mobile Application Push Notifications: You can configure push notification preferences in the settings on your mobile device.
  • Cookies: Most browsers let you remove and/or stop accepting cookies. If you do not accept cookies, however, you may not be able to use all functionality of the Services. Visit www.allaboutcookies.org for more information.
  • Advertising Choices: You can limit the use of your information for interest-based advertising by blocking third-party cookies in your browser settings, using browser plug-ins/extensions, or using your mobile device settings. You can also opt out via industry programs like the Network Advertising Initiative (NAI) and the Digital Advertising Alliance (DAA).

We will retain your personal information for so long as your account is active or as necessary to fulfill the purpose of collection, including for the purposes of satisfying any legal, accounting, or reporting requirements, to establish and defend legal claims, for fraud prevention purposes, or as long as required to meet our legal obligations. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and applicable legal requirements.

Technical, contractual, administrative and physical security measures and safeguards have been adopted to protect your personal information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. Personal information collected from our website is kept in a safe and secure system. Unfortunately, no security system can be guaranteed to be 100% secure. Accordingly, we cannot guarantee the security of your information and cannot assume liability for improper access to it. By using our service, including our website and user interfaces, or providing information to us through any means, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the service.

8. Children's Privacy

The Platform and Services are not intended for use by anyone under the age of 13 (or other age as required by local law), and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13 without the consent of the child's parent or guardian as required by law, we will delete it.

9. Other Websites, Platforms, and Applications

Freetivity may be provided through platforms such as gaming systems, smart TVs, mobile devices, set top boxes and a number of other Internet connected devices. These platforms may have separate and independent privacy statements, notices and terms of use, which we recommend you read carefully. In addition, you may encounter third party applications that interact with Freetivity. Freetivity is not responsible for the information handling practices of these other applications and platforms. The Website may contain links to independently owned, controlled and/or managed third party Internet sites to which this Privacy Policy does not apply. If you view these sites, the sites may assign a cookie. Freetivity does not control these cookies, nor is it responsible for any marketing or other use of your information by these third parties. Payment processors like Stripe and PayPal also have separate and independent privacy policies.

10. International Transfer of Information

Freetivity operates globally, and we have service providers in various countries. Your personal information may be collected, used, and stored in these countries or other locations outside of your home country. Privacy laws in the locations where we handle your personal information may not be as protective as the privacy laws in your home country. By providing your personal information, where applicable law permits, you specifically and expressly consent to such transfer and processing and the collection, use, and disclosure set forth herein. 12. Region-Specific Information

California "Shine the Light" Requests:

Under California Civil Code sections 1798.83-1798.84, California residents who have an established business relationship with a company are entitled to ask for a notice describing what categories of personal information we share with third parties for the third parties' direct marketing purposes. Freetivity does not disclose personal information obtained through our Services to third parties for their direct marketing purposes. Accordingly, we have no obligations under California Civil Code §1798.83.

Notice to Nevada Residents:

Nevada Revised Statutes Chapter 603A allows Nevada residents to opt-out of the "sale" of certain types of personal information. Subject to several exceptions, Nevada law defines "sale" to mean the exchange of certain types of personal information for monetary consideration to another person. We do not currently sell personal information as defined in the Nevada law. However, if you are a Nevada resident, you still may submit a verified request to opt-out of sales by contacting us at privacy@freetivity.net, and we will record your instructions and incorporate them in the future if our policy changes.

Notice to European Residents (EEA & UK):

If you are located in the European Economic Area (EEA) or the United Kingdom (UK), this section applies to you. References to "personal information" are equivalent to "personal data" under European data protection legislation.

Controller: The controller of your personal information is Freetivity.

Legal Bases for Processing: We process your personal information based on legal bases such as contractual necessity (to provide Services), legitimate interests (e.g., research, marketing where consent not required, fraud prevention), consent (for specific uses like certain marketing or cookies), and legal obligations.
