You may be required to create a Freetivity user account (your "Account") to access certain features. You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to create an Account. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
When you register, you must provide true, accurate, and complete information and keep it updated. You are responsible for safeguarding your password and for all activities under your Account. You may not impersonate others or use an account without authorization. Notify us immediately of any unauthorized use.
Freetivity is a video platform where users ("Viewers") can discover and watch Video Content, and where approved users ("Creators") can upload and share their video Content related to hobbies, skills, gacha, and various activities. Viewers can interact with Content and Creators through features like comments, likes, and following. Our site emphasizes creative freedom and content protection.
Creators are responsible for the Content they upload and for complying with all applicable laws and our policies, including the Content Guidelines and Copyright Policy.
We are not party to any direct agreement between Creators and Viewers beyond providing the platform for interaction. We do not endorse any specific Content on the Service unless explicitly stated.
You may not access or use the Service for any purpose other than that for which we make it available. All users must adhere to our Content Guidelines, which are incorporated into these Terms by reference. This includes respecting creative freedom while ensuring no unfair takedowns or abuse of our content protection systems.
Prohibited activities include, but are not limited to: illegal activities, harassment, hate speech, posting infringing content, spamming, distributing malware, impersonation, and attempting to disrupt the Service. You represent and warrant that you have all necessary rights, licenses, consents, and permissions to publish your Contributions and to grant Freetivity the license described above. You are solely responsible for your Contributions and the consequences of posting or publishing them. Freetivity supports the sharing of diverse content, including gacha videos, provided they adhere to our guidelines.
The Service and its original content (excluding Contributions provided by users), features, and functionality are and will remain the exclusive property of Freetivity and its licensors. The Service is protected by copyright, trademark, and other applicable intellectual property laws.
Freetivity respects the intellectual property rights of others. If you believe that your copyright has been infringed on the Service, please follow the procedures outlined in our Copyright Policy. We are committed to content protection and processes that prevent unfair takedowns.
These Terms remain in effect while you use the Service. We may terminate or suspend your Account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your Account, you may do so by following the instructions on the Service or contacting us. Certain provisions of these Terms will survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If a dispute arises from these Terms or your use of the Service that cannot be resolved through discussion, we agree to resolve such disputes through binding arbitration in an agreed-upon location, in accordance with the rules of a recognized arbitration association. Any election to arbitrate by one party will be final and binding on the other. YOU UNDERSTAND THAT IF EITHER PARTY ELECTS TO ARBITRATE, NEITHER PARTY WILL HAVE THE RIGHT TO SUE IN COURT OR HAVE A JURY TRIAL.
CLASS ACTION WAIVER: YOU AND FREETIVITY AGREE THAT ANY ARBITRATION WILL BE LIMITED TO THE DISPUTE BETWEEN FREETIVITY AND YOU INDIVIDUALLY. YOU ACKNOWLEDGE AND AGREE THAT YOU AND FREETIVITY ARE EACH WAIVING THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. Further, unless both you and Freetivity otherwise agree in writing, an arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of any class or representative proceeding.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE'S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE SERVICE AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICE, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE, (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICE BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE.
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING (OR $50, WHICHEVER IS GREATER).

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your Contributions; (2) use of the Service; (3) breach of these Terms; (4) any breach of your representations and warranties set forth in these Terms; (5) your violation of the rights of a third party, including but not limited to intellectual property rights; or (6) any overt harmful act toward any other user of the Service with whom you connected via the Service.
